Harry Macklowe shrunk wife’s 432 Park Avenue apartment amid divorce: lawsuit

Linda Macklowe claims that her estranged husband annexed a portion of her 78th-floor spread

Developer Harry Macklowe has yet another lawsuit on his hands—and this one is coming from his estranged wife, Linda. Amid the former couple's $2 billion divorce battle, Linda has filed suit against her husband for allegedly downsizing an apartment she bought at Harry's marquee property, 432 Park Avenue.

According to The Real Deal, the fight over square footage began all the way back in 2013, when the couple purchased adjacent apartments on the Rafael Viñoly-designed supertall's 78th floor. But Linda's suit claims that closings on her $14 million pad were delayed four times.

Then, this summer, Macklowe Properties and co-developer CIM Group filed plans to change the size of the two apartments. Linda's apartment allegedly shrunk from 2,663 square feet to 1,766 square feet, and from three bedrooms to one bedroom. Her lawsuit claims that the extra square footage was added to Harry Macklowe's own adjacent unit.

"While the offering plan grants the sponsor a limited right to amend the plans and specifications of the building, nothing in the offering plan grants the sponsor the right to effect this unwarranted amendment," Linda's attorney Adam Leitman Bailey told TRD.

For his part, Harry disputed the claims through a spokesperson, who told TRD that Linda "has categorically stated that she did not want to live in, did not intend to live in and did not want to buy the apartment" at 432 Park Avenue. (She apparently still has a 20,000-square-foot Plaza pad to come home to.)
